This Privacy Notice is exclusive for the ARKET App and its registered users. It is supplementary to the Terms of Service providing detailed information on the processing of your personal data. 

 

H & M Hennes & Mauritz GBC AB is the controller and responsible for processing of personal data and to protect your privacy.

Why do we use your personal data?
 

We use your personal data to provide you with, and administer your use of the ARKET App and its Services, to enable you to enjoy and easily navigate the App.


 

How do we process your personal data?
 

When you create an Account, we process information you provide to us, such as name and contact details, account settings and preferences. Account Data is used for creating your App account, send you in-App notifications, in browser and/or through available social media messaging services.
 

We will collect and use service data related to your in-app behaviour, navigation and scanning operations. Service Data is used by us and our partners (often in combination with Account Data) to deliver the requested services and personalized in-App content, offers, and promotions. Service Data is collected whenever you use the App in a logged-in mode. If you are not logged-in to your App account, we will not track your usage and behaviour. 
 

When you make a purchase through the App, we use your personal data to be able to process your purchase order and payment transactions, and to manage your deliveries, claims, returns and refunds in a secure and effective manner.
 

To identify the correct store for in-app check out we will access one-time current location data.
 

Data collected for the purposes mentioned above may also be used, under certain conditions and limitations, for marketing, business development and analytics purpose and to detect fraud and thefts in connection with in-app check out and to comply with applicable laws. 
 

 

What is the legal ground to process your personal data?
 

We only process your personal data to the extent necessary to perform and deliver the services and benefits that come with the ARKET App. Such processing is limited to what is necessary to fulfil the ARKET App Terms & Conditions.

 

Personal data used to generate and distribute offers and promotions is based on our legitimate business interest.
 

Location data will be processed based on your permission to access your device location data.



Who has access to your personal data?
 

We may share your personal data within the H&M Group whenever necessary to fulfil the intended processing purpose. For the same reason, personal data is also shared with suppliers carrying out certain tasks on our behalf, such as data analytics. ARKET is always fully responsible for its suppliers. 
 

We may from time to time also share personal data with independent third parties, such as electronic communication providers, for the purpose of sending messages and notifications to you, or to reach out to you for any other reason. Please be aware that many of these recipients are third parties and have an independent right or obligation to process your personal data in their own names. 

 

How long do we keep your data?
 

We keep and continue to process your Account Data for as long as necessary to fulfil our contractual obligations, at the latest until the ARKET App is terminated. We will only use your Service Data linked to you for 3 months to deliver the agreed services and features. After 3 months we will have the Service Data anonymized and only use it for analytics purpose.
 

Your ARKET App account will be active until it’s terminated by either You or ARKET. You may terminate your ARKET App account at any time, and for any reason, using settings within the App or by contacting customer service, customerservice@arket.com.
 

If you have redeemed an offer within the App, we will keep your Service data for 3 months from purchase date, due to our contractual obligations with you. When that period is fulfilled, all account and service data will then cease immediately.
 

We will process your Purchase Data for no longer than necessary for us to perform our contractual obligations. If you are a holder of an ARKET account, we may keep your personal data for a longer period, read more about this under the Privacy Notice for My ARKET Account.
 

For Tax & Accounting purpose we will save your data according to applicable legislation, read more about this under the Privacy Notice for Tax & Accounting.
 

If you haven’t been logged in for 3 years, ARKET will terminate your account. If your user account is terminated, irrespective of by you or by ARKET, your access to the log-in features within the ARKET App will cease immediately.
 

We will keep your personal data for a longer period of time if there are any legal requirements or if there is an ongoing dispute.
